Circumstances When a Patent is Not Granted
A patent will not be issued for inventions or creations that include:
- Discoveries of new plant or animal species, as well as biological methods of producing plants or animals, except for scientific methods related to microbiology and microbiological products, according to the executive regulations of the law.
- Human or animal diagnostic, treatment, or surgical methods.
- Scientific principles, discoveries, theories, and mathematical methods.
- Business rules, plans, or methods utilized for purely mental activities.
- Natural materials, unless it involves the method of extraction or purification.
- Inventions that contravene public order or morals, or that pose a risk to human life, health, or the environment upon use.
Tenure
Validity of the Patent
A patent remains valid for 20 years from the date of application or from the date of international filing.
Essentials
Documents Required for Filing a Patent Registration in the UAE
- A power of attorney that is duly legalized.
- If the applicant is a company, a legalized extract from the Commercial Register or the Memorandum of Association must be submitted.
- A copy of the specifications and claims in English, along with their Arabic translation.
- A set of drawings related to the invention.
- An abstract of the invention.
- A duly legalized deed of assignment signed by the inventor if the applicant is not the inventor.
- A certified copy of the application that indicates the filing date, number, and country.
